These terms are the agreement between your garage and Zephylus Ltd (company 17033409, 61 Bridge Street, Kington, HR5 3DJ), which runs Zephy. By creating a garage in Zephy you agree to them on behalf of your business. Questions: hello@zephylus.com.
1. What Zephy is
Zephy is an online tool for garages to log jobs, make and send invoices, and keep each vehicle's job history. It is for businesses, not for personal or household use.
2. Your account
- Keep your sign-in safe. You are responsible for what is done in your garage's account.
- The details you give about your garage (name, address, VAT number and so on) must be correct, because they go on your invoices.
- Tell us straight away at hello@zephylus.com if you think someone else has got into your account.
3. Your records are yours
- The jobs, customers and invoices you put into Zephy belong to your garage. You can download all of them at any time from Settings, Your data.
- We only use them to provide Zephy to you, as set out in the privacy notice.
- You are responsible for having the right to put your customers' details into Zephy, and for telling them how you use their information.
4. Checking your invoices
Zephy helps you write invoices, but you are responsible for what they say: the prices, the work described, VAT, and your tax. Voice drafts and registration look-ups can be wrong, so check every job before you save it and every invoice before you send it. Make, model and MOT details come from the DVSA and are shown as they are given to us.
5. Paying for Zephy
- Zephy is free while it is being tested. Before any charge starts, we will tell you the price and you will choose to start a plan.
- Paid plans are billed in advance each month (or year, if offered) through Stripe. You can cancel at any time; the plan runs to the end of the period already paid, and part periods are not refunded.
- We will give you at least 30 days' notice of any price change, so you can cancel first if you wish.
- If a payment fails and is not put right, your account becomes read-only: you can still see and download everything, but can't add new jobs until it is paid. We never delete your records because of a missed payment.
6. Fair use
Please don't use Zephy to break the law, send spam, try to get into other garages' records, or overload or attack the service.
7. Keeping Zephy running
We work to keep Zephy available and back it up every day, but we can't promise it will never be down. We may improve or change features over time; if we remove something important, we will tell you first.
8. Ending
- You can stop using Zephy and close your account at any time by writing to hello@zephylus.com.
- We may close an account that seriously breaks these terms, after warning you where we can.
- When an account closes, you have 90 days to download your records. After that we delete them.
9. Liability
If something goes wrong, our total liability to you is limited to what you paid us for Zephy in the 12 months before. We are not liable for lost profits or indirect losses. Nothing in these terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence, or for fraud.
10. Changes to these terms
We may update these terms. We will change the date at the top and tell you in Zephy about any important change at least 30 days before it applies.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
